data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>En respuesta a diversas organizaciones sociales sobre la petici\u00f3n de ejercer la competencia constitucional de promover, por esta Comisi\u00f3n de Derechos Humanos del Estado de Hidalgo, Acci\u00f3n de Inconstitucionalidad mediante escrito de demanda ante la Suprema Corte de Justicia de la Naci\u00f3n por la Promulgaci\u00f3n y Publicaci\u00f3n del Decreto N\u00famero 203, publicado en el Peri\u00f3dico Oficial del Estado de Hidalgo con fecha 9 de septiembre de 2019, por el que se, REFORMA, DEROGA Y ADICIONA DIVERSOS ART\u00cdCULOS DEL C\u00d3DIGO ELECTORAL DEL ESTADO DE HIDALGO, en lo concerniente al art\u00edculo 295 incisos a) al x) del mismo, la CDHEH informa lo siguiente:<\/h4><p>\u00a0<\/p><ul><li><h4>Entrando en materia, en relaci\u00f3n con los derechos de los pueblos y comunidades ind\u00edgenas, el articulado que se pretende impugnar establece que se ADICIONA un T\u00cdTULO X BIS, DE LA PARTICIPACI\u00d3N DE LOS HOMBRES Y MUJERES IND\u00cdGENAS EN LOS CARGOS P\u00daBLICOS, un APARTADO A, DE LOS PUEBLOS Y COMUNIDADES IND\u00cdGENAS Y SU DERECHO A DESIGNAR LA FORMA DE ELECCI\u00d3N DE SUS AUTORIDADES MUNICIPALES y los art\u00edculos 295 a al 295 e, un APARTADO B, DEL PROCEDIMIENTO DE CONSULTA y los art\u00edculos 295 f al 295 k, un APARTADO C, DE LAS PREVENCIONES GENERALES EN ELECCI\u00d3N POR SISTEMAS NORMATIVOS INTERNOS, y los art\u00edculos 295 l al 295 \u00f1, un APARTADO D, DE LA REPRESENTATIVIDAD IND\u00cdGENA MUNICIPAL EN LA ELECCI\u00d3N POR SISTEMA DE PARTIDOS y el art\u00edculo 295 o, un APARTADO E, PREVENCIONES COMUNES EN ELECCIONES POR SISTEMAS NORMATIVOS INTERNOS Y POR SISTEMA DE PARTIDOS y los art\u00edculos 295 p al 295 u, un APARTADO F, DE LA REPRESENTATIVIDAD IND\u00cdGENA EN LOS PODERES LEGISLATIVO Y EJECUTIVO y los art\u00edculos 295 v al 295 z; art\u00edculo 296 Bis; fracci\u00f3n III y IV del art\u00edculo 342; fracci\u00f3n VIII del art\u00edculo 385.<\/h4><\/li><\/ul><p>\u00a0<\/p><ul><li><h4>Resulta trascendental para esta Comisi\u00f3n de Derechos Humanos del Estado de Hidalgo resaltar que, el articulado antes citado, es una ADICI\u00d3N a la Legislaci\u00f3n Electoral Local, lo que conlleva en la positivizaci\u00f3n de una serie de principios de representaci\u00f3n de intereses colectivos, mismos que antes de la publicaci\u00f3n del Decreto respectivo, que da vigencia a la norma, no exist\u00edan.<\/h4><\/li><\/ul><p>\u00a0<\/p><p><strong>\u00a0<\/strong><\/p><p><strong>\u00a0<\/strong><\/p><ul><li><h4><strong>El<\/strong><strong> promover escrito de demanda de Acci\u00f3n de Inconstitucionalidad<\/strong>, en este caso, sobre una serie de derechos en su momento garantizados mediante la publicaci\u00f3n del Decreto 203 en comento, perseguir\u00eda equivocadamente efectos anulatorios de dicho Decreto, y con ello <strong>quedar\u00eda eliminado el \u00fanico precedente hist\u00f3rico del reconocimiento de los derechos ind\u00edgenas en materia pol\u00edtica en el C\u00f3digo Electoral de nuestro Estado, quedando nuevamente desprotegidos dichos grupos de poblaci\u00f3n vulnerable por cuanto al ejercicio de sus derechos humanos en la vertiente pol\u00edtico electoral<\/strong>, m\u00e1xime, que toda norma es perfectible, <strong>en una estricta aplicaci\u00f3n del Principio de Progresividad de Derechos Humanos, se vulnerar\u00eda este principio con base en la misma prohibici\u00f3n de regresividad del disfrute de los derechos fundamentales y, en el mismo sentido, con la obligaci\u00f3n positiva de promoverlos de manera progresiva y gradual.<\/strong><\/h4><\/li><\/ul><p>\u00a0<\/p><ul><li><h4>Teniendo en consideraci\u00f3n estas razones esta Comisi\u00f3n de Derechos Humanos del Estado de Hidalgo considera el no ejercer su facultad constitucional de interponer escrito de demanda de inconstitucionalidad con respecto al Decreto N\u00famero 203, publicado en el Peri\u00f3dico Oficial del Estado de Hidalgo con fecha 9 de septiembre de 2019, por el que se, REFORMA, DEROGA Y ADICIONA DIVERSOS ART\u00cdCULOS DEL C\u00d3DIGO ELECTORAL DEL ESTADO DE HIDALGO, en lo concerniente al art\u00edculo 295 incisos a) al x) del
