Presidente Alejandro Habib Nicol\u00e1s<\/em><\/h4>

\u00a0<\/strong><\/p>

El presidente de la Comisi\u00f3n de Derechos Humanos del Estado de Hidalgo (CDHEH), Alejandro Habib Nicol\u00e1s, inform\u00f3 que, derivado de los fen\u00f3menos focalizados en diferentes municipios sobre violencia colectiva, mejor conocidos como, linchamientos, emiti\u00f3 la primera recomendaci\u00f3n general.<\/h4>

\u00a0<\/p>

Ante los medios de comunicaci\u00f3n, el ombudsman hidalguense, explic\u00f3 que esta Comisi\u00f3n rechaza cualquier forma de violencia, y en este sentido, debe sancionarse a quienes violenten el marco legal vulnerando los derechos de las personas.<\/h4>

\u00a0<\/p>

La recomendaci\u00f3n general CDHEH-RG-001-18 va dirigida a los 84 presidentas y presidentes municipales, as\u00ed como, a la Procuradur\u00eda General de Justicia del Estado de Hidalgo, siendo los derechos vulnerados tales como: Derecho a la vida, Seguridad jur\u00eddica, Integridad personal, Derecho a la libertad personal y Derecho a las garant\u00edas judiciales.<\/h4>

\u00a0<\/p>

Entre las recomendaciones que hace la CDHEH se encuentran:<\/h4>

PRIMERA.- Se exhorta a los 84 municipios del Estado de Hidalgo a que en sesi\u00f3n de cabildo, generen las acciones eficaces y pertinentes a fin de cumplir con sus deberes y observancia de las disposiciones en materia de seguridad p\u00fablica y justicia, en t\u00e9rminos de la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos, las Convenciones y Tratados Internacionales sobre la materia, la Constituci\u00f3n Pol\u00edtica del Estado de Hidalgo, la Ley Org\u00e1nica Municipal del Estado de Hidalgo as\u00ed como los diferentes reglamentos y bandos municipales, remitiendo a esta Comisi\u00f3n de Derechos Humanos del Estado de Hidalgo las actas para las que a este efecto se realicen.<\/h4>

SEGUNDA. – Capacitar en materia de derechos humanos y mediaci\u00f3n a funcionarios de la Polic\u00eda Municipal y Jueces Calificadores, a partir del estudio de casos de Violencia Colectiva (Linchamientos), y se env\u00eden las constancias con las que se acredite su cumplimiento.<\/h4>

TERCERA. –\u00a0 Dise\u00f1ar y publicar el protocolo de actuaci\u00f3n para casos de Violencia Colectiva (Linchamiento), y en general sobre el actuar policial seg\u00fan lo establecido por el Secretariado Ejecutivo del Sistema Nacional de Seguridad P\u00fablica, as\u00ed como por el Gobierno del Estado teniendo como marco los protocolos publicados por \u00e9ste en la materia.<\/h4>

CUARTA. – Revisar, actualizar y publicar los Bandos de Polic\u00eda y Gobierno, en los t\u00e9rminos de la Ley Org\u00e1nica Municipal del Estado de Hidalgo, con respecto a la adecuaci\u00f3n de las funciones, competencias y alcances en el desempe\u00f1o de seguridad p\u00fablica generando marcos normativos que contemplen el trato del fen\u00f3meno Violencia Colectiva (Linchamiento).<\/h4>

QUINTA. – Realizar un diagn\u00f3stico de la operatividad y efectividad de las corporaciones de policiales municipales, en un plazo no mayor a tres (3) meses, con respecto a la situaci\u00f3n real que cuentan para la atenci\u00f3n eficiente de posibles actos de Violencia Colectiva (Linchamientos), remitiendo ese diagn\u00f3stico a esta Comisi\u00f3n de Derechos Humanos del Estado de Hidalgo.<\/h4>

SEXTA. – Realizar jornadas de educaci\u00f3n c\u00edvica y cultura de la legalidad y justicia, en un plazo no mayor a 3 (meses), dirigidas a la sociedad civil con la finalidad de difundir y concientizar la importancia de vivir dentro de la legalidad y paz social y enviar a esta Comisi\u00f3n de Derechos Humanos del Estado de Hidalgo las constancias respectivas de las actividades.<\/h4>

S\u00c9PTIMA. – Que el enlace Municipal designado ante esta Comisi\u00f3n de Derechos Humanos del Estado con base en las atribuciones y competencias establecidas en la Ley Org\u00e1nica Municipal para el Estado de Hidalgo, de seguimiento puntual a las Recomendaciones dirigidas a cada Ayuntamiento con la finalidad de generar las acciones pertinentes de colaboraci\u00f3n constante en materia de difusi\u00f3n de la cultura de respeto y protecci\u00f3n de derechos humanos.<\/h4>

OCTAVA. – Coadyuvar de manera activa con la Procuradur\u00eda General de Justicia del Estado de Hidalgo para la integraci\u00f3n y seguimiento oportuno de las carpetas de investigaci\u00f3n que se inicien sobre estos hechos con la finalidad de generar las condiciones necesarias para que los habitantes de los municipios se abstengan de ejercer violencia f\u00edsica y se conduzcan dentro del marco legal.<\/h4>

NOVENA. – De igual manera, el actuar de la Procuradur\u00eda General de Justicia del Estado de Hidalgo deber\u00e1 ser contundente en este rubro, generando las medidas, investigaciones y actuaciones pertinentes para integrar las respectivas Carpetas de Investigaci\u00f3n sobre autores materiales, intelectuales e instigadores, debi\u00e9ndose determinar el grado de coparticipaci\u00f3n, en t\u00e9rminos de lo dispuesto en la normativa que rige la materia.<\/h4>

D\u00c9CIMA. – A la Procuradur\u00eda General de Justicia del Estado de Hidalgo para que, de resultar procedente de la integraci\u00f3n de las conducentes Carpetas de Investigaci\u00f3n, act\u00fae en los t\u00e9rminos de ley y sus competencias en contra de servidores p\u00fablicos, por posibles actos u omisiones derivados de su funci\u00f3n.<\/h4>
